• Categorizes issues using a Red/Amber/Green flag system
• Enables comparison of multiple properties
• Produces downloadable PDF reports

3.1 No Professional Advice

SurveyReady does not provide:

• Professional surveying services
• Structural engineering assessments
• Legal advice regarding property transactions
• Financial advice or mortgage recommendations
• Property valuation services
• Building regulation compliance checks

3.2 AI Limitations

Our AI-powered analysis:

• Relies entirely on the quality and completeness of photos and notes you provide
• Cannot detect issues not visible in photos (e.g., hidden structural problems, asbestos, underground drainage)
• Provides cost estimates only - actual repair costs may vary significantly
• Is based on general UK building standards and may not account for regional variations
• Cannot replace physical inspection by a qualified professional

3.3 Accuracy Disclaimer

While we strive for accuracy, we make no guarantees that our assessments are complete, accurate, or suitable for your specific circumstances. Cost estimates are indicative only and should not be relied upon for budgeting or purchase decisions without professional verification.

4. User Responsibilities

4.1 Accurate Information

You are responsible for:

• Providing accurate property details (address, type, age, features)
• Taking clear, well-lit photos that represent the property’s condition
• Adding honest, detailed observations in the checklist
• Not deliberately misrepresenting property conditions

4.2 Appropriate Use

You agree to:

• Use the Service only for properties you are genuinely viewing or considering purchasing
• Not use the Service for commercial property assessment (residential properties only)
• Not share your account credentials with others
• Not attempt to reverse-engineer or copy our AI prompts or technology
• Not upload offensive, illegal, or inappropriate content

4.3 Professional Survey Requirement

You acknowledge that SurveyReady reports are preliminary tools only. You agree to:

• Commission a full RICS building survey before purchasing any property
• Not rely solely on SurveyReady reports for purchase decisions
• Consult qualified professionals (surveyors, solicitors, mortgage brokers) before proceeding with a property transaction

5. Account and Registration

5.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

5.2 Account Suspension or Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity or payment disputes
• Upload illegal, offensive, or inappropriate content
• Attempt to abuse or exploit the Service

6. Payment Terms

6.1 Pricing Structure

• Free Tier: First 2 property assessment reports are free (no credit card required)
• Pay Per Report: £9.99 per additional report
• Property Hunter Bundle: £39 for 5 reports (£7.80 per report, 22% discount)

6.2 Payment Processing

• All payments are processed securely via Stripe
• Prices are displayed in British Pounds (GBP) and include VAT where applicable
• Payment is required before generating reports beyond the free tier
• We do not store your full payment card details on our servers

6.3 Credits and Expiry

• Purchased report credits never expire
• Credits are non-transferable between accounts
• Unused credits remain in your account until used or your account is deleted

6.4 Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect credits already purchased. We will provide reasonable notice of significant price increases.

7. Refund Policy

7.1 Used Reports - No Refunds

Once you have generated a property assessment report, that report credit is considered used and is non-refundable. This applies even if:

• You are unsatisfied with the AI assessment
• The cost estimates differ from actual repair quotes
• You decide not to proceed with the property purchase
• You uploaded incomplete or low-quality photos

7.2 Unused Credits - 14-Day Refund Window

For unused report credits, you may request a refund within 14 days of purchase, provided:

• The credits have not been used to generate any reports
• Your request is made within 14 days of the original purchase date
• You have not previously requested refunds for the same purchase

7.3 How to Request a Refund

To request a refund for unused credits:

• Subject line: “Refund Request”
• Include: Your account email, purchase date, and transaction ID
• Refunds are processed within 5-10 business days to your original payment method

7.4 Exceptional Circumstances

We may offer refunds outside these terms in exceptional circumstances (e.g., service outages preventing report generation, technical errors). Such refunds are at our sole discretion.

8. Intellectual Property

8.1 Our Intellectual Property

SurveyReady owns all rights to:

• The SurveyReady website, software, and technology
• Our AI prompts, algorithms, and assessment methodologies
• The SurveyReady name, logo, and branding
• Checklist templates and report formats

You may not copy, reproduce, or redistribute any part of the Service without our written permission.

8.2 Your Content

You retain ownership of:

• Photos you upload during assessments
• Notes and observations you add to checklists
• Property details you provide

8.3 License to Use Your Content

By using the Service, you grant us a limited license to:

• Process your photos and observations to generate AI reports
• Store your reports in your account dashboard
• Use anonymized, aggregated data to improve our service (e.g., “Properties built in the 1930s commonly have X issue”)

We will never sell your photos, property addresses, or personal data to third parties. We will never use your content for advertising or marketing purposes.

8.4 Generated Reports

You own the PDF reports generated by the Service. You may download, print, and share them with professionals (e.g., mortgage brokers, solicitors) as needed for your property purchase.

9. Limitation of Liability

9.1 No Warranty

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• AI assessments will be accurate, complete, or suitable for your purposes
• Cost estimates will match actual repair quotes
• The Service will detect all property issues or defects

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURVEYREADY SHALL NOT BE LIABLE FOR:

• Any property purchase decisions you make based on our reports
• Any financial losses resulting from inaccurate assessments or cost estimates
• Any undiscovered property defects or issues
• Any consequential, indirect, or incidental damages arising from use of the Service
• Any damages exceeding the amount you paid for the Service in the past 12 months

9.3 Indemnification

You agree to indemnify and hold harmless SurveyReady from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights (e.g., uploading photos of properties without permission)

10. Third-Party Services

The Service relies on third-party providers:

• Clerk - Authentication and account management
• Supabase - Data storage
• Anthropic Claude API - AI-powered analysis
• Stripe - Payment processing
• Vercel - Website hosting

We are not responsible for the performance, availability, or actions of these third-party services. Service interruptions may occur due to third-party outages beyond our control.

11. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with UK GDPR.

12. Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose
• Upload photos containing illegal content, child exploitation material, or offensive imagery
• Attempt to hack, reverse-engineer, or compromise the Service’s security
• Use automated tools (bots, scrapers) to access the Service
• Resell or redistribute reports generated by the Service
• Impersonate others or create fake accounts
• Share your account credentials or allow others to use your account

13. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change pricing, features, or availability
• Update checklist templates or assessment methodologies
• Upgrade or change AI models used for analysis

We will provide reasonable notice of significant changes that materially affect the Service.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service features. Significant changes will be communicated via:

• Prominent notice on the website

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Termination

You may terminate your account at any time by:

• Requesting account deletion (all data will be permanently deleted, except payment records retained for legal compliance)

Unused report credits are forfeited upon account deletion. No refunds will be provided for unused credits after the 14-day refund window.

• Violate these Terms
• Engage in fraudulent activity
• Upload illegal or offensive content
• Abuse or exploit the Service

16. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SurveyReady regarding use of the Service, and supersede any prior agreements or understandings.
